Which Estate Documents Fit My Situation?

General information, not legal advice. Tick anything that applies and the documents people commonly use for it are marked — but all four are always shown, with what each one actually does. Which ones suit a particular person is a question for an attorney licensed in their state.

This is general information, not legal advice. Legacy Legal AI is not a law firm. This page explains what four common documents do; it does not review your situation, tell you which ones apply to you, or take the place of advice from an attorney licensed in your state.

What the four documents do

A will speaks after death: who receives property, who handles the estate, who raises minor children. A power of attorney works during life: who may handle money and paperwork for someone who cannot. A healthcare directive also works during life: what treatment a person wants and who speaks for them with doctors. A revocable living trust works in both: a trustee manages property retitled to the trust during incapacity and distributes it at death without probate of that property. Many people end up with several, because each covers something the others do not.
